1. Acceptance of Terms
By accessing or using cbcSchool App (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part, you may not use the Service.
2. Description of Service
cbcSchool App is a free, offline-first Progressive Web App (PWA) for Kenyan schools providing: digital attendance tracking, CBC report card generation, M-Pesa fee collection via STK Push, WhatsApp parent notifications, and portals for teachers, parents, headteachers, and a school marketplace. The Service is provided "as is" and "as available."
3. Eligibility
- Schools must be registered educational institutions in Kenya
- Users must be at least 18 years old (teachers, headteachers, parents)
- Parents paying premium fees must have a valid M-Pesa account
4. Accounts & Access
- Schools register via a headteacher; a unique school ID is issued
- Teachers and headteachers log in via phone OTP (no passwords)
- Parents access the portal via phone OTP; no app install required
- You are responsible for keeping your phone number secure
- Unauthorised access attempts will result in account suspension
5. Pricing & Payments
- School Plan: Free forever for schools, teachers, headteachers
- Parent Premium: KSh 100 per term per child (optional)
- Payments processed via M-Pesa STK Push (Safaricom Daraja API)
- No refunds for partial terms; premium features activate on confirmed payment
- Prices in KES; subject to change with 30 days' notice
6. Offline-First & Data Sync
- Attendance and assessment data stored locally (IndexedDB) when offline
- Auto-sync via Background Sync API when connectivity returns
- Schools own their data; export available anytime (CSV/PDF)
- We are not liable for data loss if device is lost before sync
7. Third-Party Services
cbcSchool App integrates with:
- Safaricom Daraja API (M-Pesa) — subject to Safaricom terms
- Meta WhatsApp Business API — subject to Meta terms
- Africa's Talking (SMS OTP) — subject to their terms
We are not responsible for downtime, errors, or policy changes by these providers.
8. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or extract source code
- Share login OTPs or impersonate other users
- Upload malicious code, spam, or illegal content
- Use the Service for unlawful activities under Kenyan law
- Scrape, crawl, or bulk-extract data without permission
9. Intellectual Property
cbcSchool App, its branding, UI, and backend are owned by Smarternow Data Venture. School data (attendance, reports, fees) belongs to the school. Parents own their payment records. You grant us a licence to process data solely to provide the Service.
10. Disclaimers
- No warranty of uninterrupted, error-free, or secure service
- CBC report templates follow KICD guidelines; schools verify compliance
- M-Pesa payments depend on Safaricom network availability
- WhatsApp delivery depends on Meta's infrastructure
11. Limitation of Liability
To the maximum extent permitted by Kenyan law, cbcSchool App is not liable for indirect, incidental, special, or consequential damages (including data loss, lost fees, or academic disruption). Our total liability shall not exceed KSh 10,000 or the fees paid by you in the prior 12 months, whichever is greater.
12. Termination
- Schools may close their account anytime; data purged within 30 days
- We may suspend accounts violating these Terms or for security reasons
- cbcSchool App may discontinue the Service with 90 days' notice
13. Governing Law
These Terms are governed by the laws of the Republic of Kenya. Disputes resolved in Kenyan courts.
14. Changes
We may update these Terms. Continued use after changes constitutes acceptance. Material changes notified via email or in-app banner.
